India, US announce mutually agreed solution in dispute over agricultural import measures

On 13 July 2023, India and the United States notified mutually agreed solutions in the following WTO dispute proceedings:

  • DS436:  “United States — Countervailing Measures on Certain Hot-Rolled Carbon Steel Flat Products from India”
  • DS456: “India — Certain Measures Relating to Solar Cells and Solar Modules”
  • DS510: “United States — Certain Measures Relating to the Renewable Energy Sector”
  • DS541: “India — Export Related Measures”
  • DS547: “United States — Certain Measures on Steel and Aluminium Products”
  • DS585: “India — Additional duties on certain products from the United States”

Mutually agreed solution

At any stage during the dispute settlement process, parties can settle the dispute by finding a “mutually agreed solution”. Solutions mutually acceptable to the parties to the dispute must also be consistent with the relevant WTO agreement and must not nullify or impair benefits accruing under the agreement to any other member. Parties are required to notify the Dispute Settlement Body and relevant councils and committees of any mutually agreed solution they have reached.
